Payments are processed by Creem (creem.io), acting as Merchant of Record for all transactions on PromoTracker. Creem assumes full legal responsibility for sales, including the collection and remittance of applicable taxes.

Intellectual Property

All content on this website (text, images, logo, and source code of the PromoTracker application) is the exclusive property of David Cohen. Any reproduction, representation or distribution, in whole or in part, without prior written authorization is strictly prohibited.

Liability

PromoTracker makes every effort to ensure the accuracy and currency of information published on this website. However, PromoTracker cannot guarantee the accuracy, completeness or timeliness of the information provided.

Terms of Service

1. Overview

These Terms of Service govern the sale of software licenses for PromoTracker, a macOS desktop application published by David Cohen (sole trader, SIRET 512 307 653 00034), hereinafter referred to as "PromoTracker".

By purchasing a license, you agree to these Terms in full. Please read them carefully before completing your purchase.

2. Products

PromoTracker offers two types of licenses:

• Annual subscription: access to the software for 12 months, automatically renewed unless cancelled.
• Lifetime license: permanent access to the software with no time limitation, including all major updates available during the product's commercial lifecycle.

3. Free Trial

PromoTracker offers a 30-day free trial. No credit card is required to start your trial. We strongly encourage you to try the software before purchasing.

4. Pricing

All prices are displayed in euros, inclusive of applicable taxes (VAT included). PromoTracker reserves the right to change its pricing at any time. Orders are billed at the price in effect at the time of purchase.

5. Payment

Payment is made online, securely, through Creem (creem.io), our Merchant of Record. Accepted payment methods include: Visa, Mastercard, and American Express. Payment is due immediately upon order.

6. Delivery

Upon payment confirmation, the customer receives by email:

• A download link for the macOS installer (.dmg file)
• A unique license key to activate the software

Delivery is instant and electronic. No physical media is shipped.

7. Right of Withdrawal

In accordance with applicable consumer protection laws, the right of withdrawal does not apply to digital content where execution has begun with the customer's express prior consent. By activating your license key, you expressly acknowledge waiving your right of withdrawal.

As we offer a 30-day free trial, we encourage all customers to evaluate the software fully before purchasing.

8. License Grant

Purchasing a PromoTracker license grants the buyer a personal, non-exclusive, non-transferable right to use the software. The license is valid for one user on a maximum of 2 devices simultaneously. Any resale, redistribution or sharing with third parties is strictly prohibited.

9. Renewal and Cancellation (Annual Subscription)

Annual subscriptions are automatically renewed at the end of each billing period. You may cancel your subscription at any time through your customer portal or by contacting hello@promotracker.fr. Cancellation takes effect at the end of the current billing period. No pro-rata refund is issued.

10. Refunds

Given the nature of digital software products and the availability of a free trial, refunds are not issued after a license key has been activated. If you experience a technical issue preventing you from using the software, please contact us at hello@promotracker.fr and we will do our best to resolve it.

11. Updates

All license holders receive software updates free of charge during their license period. PromoTracker reserves the right to modify, improve or discontinue features at any time.

12. Support

Support is provided by email at hello@promotracker.fr. PromoTracker commits to responding within 5 business days.

13. Limitation of Liability

PromoTracker is a tool for organizing and tracking music promotional campaigns. PromoTracker cannot be held responsible for the results obtained by users in their music promotion activities. The software is provided "as is", without warranty of any kind beyond what is expressly stated in these Terms.

14. Governing Law

These Terms are governed by French law. In the event of a dispute, an amicable resolution will be sought first. Failing that, French courts shall have jurisdiction.

15. Dispute Resolution

In accordance with EU Regulation No. 524/2013, you may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

Privacy Policy

PromoTracker (David Cohen, sole trader) is committed to protecting your privacy in accordance with the General Data Protection Regulation (GDPR) and applicable French data protection law.

PromoTracker collects the following data:

• Purchase data: name, email address, payment information (processed by Creem, not stored by PromoTracker)
• Activation data: license key, device identifier (for license activation management)
• Contact data: email address provided when contacting support
• Application data: data entered within the app (artists, contacts, campaigns) is stored locally on your device only and is never transmitted to our servers

• Transactional emails (purchase confirmation, license key delivery)

Data processing is based on:

• Contract performance (license delivery)

• Order data: 10 years (accounting obligation)
• License data: duration of license + 1 year
• Support contact data: 3 years after last contact

Your data is shared only with:

• Creem (creem.io) — payment processing and Merchant of Record
• OVH — website hosting

No data is sold or shared for advertising purposes.

8. Cookies

The promotracker.fr website uses only strictly necessary cookies for its operation. No advertising or third-party tracking cookies are used without your explicit consent.

PromoTracker implements appropriate technical and organizational measures to protect your data against unauthorized access, loss or disclosure. All payments are SSL-encrypted and processed exclusively by Creem.

10. International Transfers

Creem may process certain data outside the European Union. Such transfers are governed by appropriate safeguards compliant with the GDPR (standard contractual clauses).

11. Your Application Data

All data you enter into the PromoTracker application — including artist profiles, curator contacts, campaign history, press kits and metadata — is stored exclusively on your local device. PromoTracker does not have access to this data and it is never uploaded to any server.
